I need some help – I’m in the midst of filling out all the mountains of paperwork for Etsy’s legal team to prove that this shop is stealing my images and using them to sell her necklaces.

I have tons of solds from months and months before her shop even opened.  I also found another etsy seller that had her images stolen by Imprinted Possessions.  I have been in contact with her ( because we discovered that we both want her shop closed by etsy.  JLynnCreations just got Etsy to remove her photos (if you check Imprinted Possessions’ sold items, you will see that many of her solds are “no longer available”.  Those are the ones that JLynn successfully got Etsy to remove last week.  So, she’s stealing images from more than 1 shop, got caught and is still doing it.  The worst part for me is that one of my pieces is her best damn seller (and she’s selling it for me than me)!  Out of her 49 sales, I think 10 or 11 are my necklaces, images and all.  Just sickening.  I have contacted Etsy and got the standard “prove it” e-mail, so I am in the process of doing all of that right now.  I also asked twice if her shop would be shut down for being a repeat offender, but of course got no reply.  JLynnCreations and I both want to make sure she doesn’t do this to anyone else and didn’t know if you could help us.  If you need JLynnCreation’s contact info, I can get that for you or you can convo her at her shop too.  We both didn’t file with paypal (for fradulent selling and to possibly recoup money that was collected selling our items) out of fear of repercussions/retaliation from her even though she has sold over $350 using my images and over $150 using JLynnCreation’s images.

Not sure if you can do anything to help us, but figured we’d try! 🙂

    Wow, this really sucks. I’m sorry for the whole situation. I know you said you have mounds and mounds of Etsy-prove-it paperwork, but can’t some form of proof be that you sold this item before her shop even opened? On page 26 of your sold items, it’s listed as a sale, dated October 12, 2010. Her shop didn’t even open until October 18th.

    Or does that just make too much sense for Etsy?

    This might be a dumb question, but why wasn’t the offending shop closed down? Stealing someone’s photos and making a profit off of them is a very serious thing to do, and Etsy should treat it as such.

    The two shops that had their photos stolen lost those sales, and therefore could sue the offender. It’s a pretty clear case of copyright infringement. Though sadly, it’s probably not worth the headache to sue over.

    Truly unbelievable and disgusting! What gall to steal your photos so blatantly! And the funny thing is- this seller has her own photos of her pieces, so why take yours? (Well, unless if those photos are also stolen form other sellers- which could be…)

    I don’t feel too bad for the trademark infringing sellers having their stuff stolen, but I do for the others I guess.

    Damn. How stupid is that. She obviously is getting product to people, so that means she has the tools to do the actual work. How about buying a camera and setting some time aside to clickclickclick.

    A half victory – I faxed over all 8 pages of prove it paperwork to Etsy first thing this morning. I just checked her site and my photos have been removed. She has an awful lot of solds that are “no longer available”. Her shop however, is still open – despite getting caught TWICE in about 3 weeks time. That seems SO wrong to me for Etsy to allow her to have multiple offenses and stay open. I was considering filing with paypal and getting her paypal account frozen (and so was JLynn Creations) & recouping money she made selling goods with our photos, but thought it was too nasty of a thing to do, guess we’re too nice.

    Tinylovetreasures!!! YOU SHOULD DO IT! She didn’t feel bad enough to steal from you, so why should you feel bad to take but what is yours anyway?! It would be a scary thing to do but you will feel so empowered when it is done. Plus you have the backing of as they ruled in your favor and you have official signed/faxed documentation. If both of you shop owners file she will get what she deserves. If she was stealing in real life she would be in county jail!

    What the fuck, guys?! Why is etsy still allowing this OBVIOUS thief continue to sell? even when someone proves that their work is indeed being freakin’ copied by another person? Jesus. Are those assholes that hard up for money? Greedy bastards.

    Etsy did the same exact thing to our company with a repeat offender. We do ot know how to fight them! Our images are still there under the sold section! I would think Etsy is now liable for the copyright infringement since they received the proof, and are now knowingly keeping these pics on their site. I would love to sue the heck out of them. That is just wrong.

    Have you noticed she changed her shop name from Imprinted Possessions to Imprinted Designs? Might want to see if any of your pictures are being stolen there too…
