Can you really get away with it by stating…

“Disclaimer: All items are handmade. All copyrighted and trademarked images are in NO WAY being sold. These images are included FREE of charge when you purchase my design services. You are paying for the materials and labor used to design and create these items for you. I do not claim ownership on any trademarked image/logo/or graphic used in a design, as they belong to their rightful and respective owners. These items are intended for private use, not to be resold. ”

If not mass reselling, how about fee avoidance??

I recall seeing at least one topic in the forums recently about sellers claiming to give away free copyrighted images with their handmade items. So this is what they meant. The called out shop is also breaking the rules by listing an item not for sale — their sale code or whatever that is.

Dee, the owl earrings are reseller items. I think the point of the absurdly low price is more meant as ‘dumping’ — almost giving away merchandise as a method of competition — than outright fee avoidance. Some of the Chinese jewelry resellers were doing this during the holiday shopping weeks just past, too.

Holy crap… 2,653 items listed since December 14th. That’s $530.60 just on listing fees alone. I wish this dirtbag would get their shop closed down and lose all the listings and money just to teach them a lesson.

I will definitely be emailing Disney about the copyright infringements on their characters, since they’re the only company I know an email address to and I’ve seen them actually take action (though it took a few months). if anyone feels inclined to also send an email. While you’re at it, might want to also to report this copyright infringer – I’ve reported them to Disney before but it looks like they didn’t go after them (yet).

I also like how their profile says, “My creations have become really popular as I have been making and selling things since 2006.”

Good to know they’ve been in the copyright infringement business for 6 years now.

    Here is her website:
This person pushes any available buttons to make a sale!

What do you think of this?

What about the neutral FB concerning the plastic ‘tusks’? Buyer beware of estate jewelry sold online.

Ah, see…the thing is…she IS infringing on their copyrights because she is displaying their copyrighted images to get her sales – doesn’t matter if she is including someone else’s copyright images for *ahem* free *cough cough*.

It’s copyright infringement no matter how much you lie.

And she was called out before (and closed her shop) because she was doing the same thing, but adding that she was donating a portion of each sale to breast cancer research. When questioned, she said it didn’t matter because she was promoting her own website – uh-huh, this same one. Also, she wouldn’t disclose how much went to donation and exactly where the supposed donations went. That bothers me.

I noticed that the photos of the completed item for sale, in all the listings, is very small and fuzzy — poor quality pics. The selling point is clearly the images, not the products she makes.

While you’re reporting those copyright infringers to Disney, here are a couple more:

self-callout in the forums — “handmade” “vintage” mass produced charms. Lost in translation………………….

  14. Life During Wartime February 2, 2012 at 11:07 am #

HandmadeWorld88 is a reseller shop. They sell the mass made, factory assembled, watch pendants and chains as handmade jewelry. Obviously, the Chinese resellers are on Etsy to stay now. After reading that whole thread, it looks like only one person realized the OP was a reseller — and they didn’t mention it.

. . .And with 10,000+ sales, looks like they’re here to stay 😦

Here’s another one just starting out so maybe if they’re reported early . . ?

I ran across a “shop” on facebook that has the exact disclaimer. She sells crochet
character hats and states that the buyer is only paying for the material and her
time to make the hat, the character on the hat is “free”, blah, blah, blah…..
BTW, she has a couple of defunct etsy shops…..

If the shit isn’t theirs to begin with then it isn’t theirs to give away, right?
